Bail variation hearing for Charters to reside in Hong Kong will be heard this Wednesday

Bail variation hearing for Charters to reside in Hong Kong will be heard this Wednesday
The bail variation application for Fijian and British national Charlie Charters, seeking permission to reside in Hong Kong, will be heard on Wednesday.

Defence lawyer Seforan Fatiaki informed Magistrate Shageeth Somaratne of the new application this morning.

Fatiaki says the reason for the bail variation application is due to Charters’ work commitments and that he also needs to attend his uncle’s funeral in the UK.

He says that the bail variation is a matter of urgency.

FICAC lawyer Rusiate Doidoi says they require time to respond.

The ruling on the bail variation has been set for next Tuesday.

Meanwhile, the defence has also filed an application requesting FICAC to release electronic devices of Charters, stating that they are vital to him.

Fatiaki further says that there is no reason for the devices to still be in FICAC’s possession.

Doidoi responded that the electronic devices were seized under a search warrant and that the investigation is ongoing.

He further states that he does not know how long the data extraction process will take and that they also need time to respond.

Fatiaki says that his client’s device is being used to investigate the primary offender and he will address this in the hearing.

Fatiaki also informed the court that they intend to file a stay application but are awaiting rulings on the other three matters, as these have a direct bearing on their case.

Charters is charged with two counts of aiding and abetting under the Crimes Act by FICAC and is currently on bail.
