Malani’s lawyer seeks adjournment at Court of Appeal

The lawyer for Veronica Malani is seeking an adjournment in their appeal case to overturn the decision of the Director of Public Prosecutions not to prosecute the former Attorney-General and FijiFirst General-Secretary Aiyaz Sayed-Khaiyum.

This is the case where Malani had alleged that Sayed-Khaiyum was involved in a bombing at Veronica Malani’s home in 1987 when she was 14 years old.

The matter was called today before Court of Appeal President Justice Jayantha Guneratne in the Court of Appeal at the Veiuto Court complex in Suva.

Malani’s lawyer, John Rabuku says there are certain issues that he needs to go through with his client in terms of how the case sits right now.

He says it is also in terms of the success or non-success of the case.

Malani had sought leave to apply for judicial review to overturn the decision of the DPP not to prosecute Sayed-Khaiyum, alleging that he was involved in a bombing in 1987.

She had said in the Suva High Court that the blast injured her and her mother.

Suspended DPP, Christopher Pryde had declined to bring charges against Sayed-Khaiyum, saying there was insufficient credible and reliable evidence to support criminal charges.

Suspended Chief Justice Kamal Kumar had refused Malani’s leave in the High Court to challenge the DPP’s decision and ordered her to pay the DPP costs of $5,000. Justice Guneratne set directions for the filing and serving of submissions by the parties.

The case will be called again on October 9th at 9.30am.
