Lawyer applies for stay in murder proceedings as DPP is unable to find medical documents

The lawyer of one of the men charged for allegedly killing a bus driver at the Nausori Bus Stand in 2020 has applied for a stay in proceedings as the prosecution is unable to locate the driver’s medical folder.

Josateki Rokodakunivosa, Isikeli Lagibalavu and Mikaele Lawaniyale allegedly assaulted the bus driver on 3rd October 2020, and he later passed away at the CWM Hospital.

Lagibalavu’s lawyer, Kunal Singh has told the court that a permanent stay be granted if the DPP is unable to produce the documents.

He says their defence lies on the fact that the bus driver did not die because of the injury sustained due to the alleged assault.

DPP lawyer, Moira Konrote says Nausori Health Centre does not have the medical documents and has sought 21 days to look for it at the CWM Hospital as the driver was transferred there.

High Court Judge, Justice Daniel Goundar has granted the DPP 21 days to file the medical documents.

The matter has been adjourned to the 19th of August.
