The hearing in the matter where the Judicial Services Commission is seeking an order to quash the findings and recommendations of the Commission of Inquiry into the appointment of Barbara Malimali as the Commissioner of FICAC will take place on the 12th of December.
The matter was called before High Court Judge Justice Dane Tuiqereqere this morning.
JSC’s counsel, Isireli Fa says COI Chair David Ashton-Lewis has been served on the 22nd of October at the Gold Coast in Australia.
Solicitor General Ropate Green and the Acting Attorney General Siromi Turaga have been given 14 days to file their notice and affidavit in opposition.
Fa has been given until the 28th of November to reply.
Ashton-Lewis has been given until the 3rd of December to notify the court of his position.
Fa, in a statement earlier had said that the judicial review application by the JSC raises serious issues with the conduct of the COI and its findings and recommendations.
Fa had said in their opinion, its findings and recommendations are inconsistent with the evidence that was before the COI.
