The second indecent assault case involving a former senior executive of a publicly listed company will be called next month before Chief Magistrate Usaia Ratuvili.
It was heard in court that the complainant in this second case is still not in Fiji.
Chief Magistrate Ratuvili has also asked the defence and prosecution lawyers if they want him to continue to be the trial magistrate or do they want a pair of fresh eyes.
The prosecution has indicated that they do not have an issue with the Chief Magistrate continuing to oversee the case.
The case will be called on the 28th of next month.
In this second case, the man allegedly asked the victim personal questions, hugged her, rubbed her back and sniffed her hair in his office in May 2019.
Last Friday, the Chief Magistrate handed down a suspended sentence for one count of indecent assault to the former executive.
He was sentenced to 14 months which has been suspended for 2 years.
This means the man will have to serve the sentence if he commits an offence within the suspension period.
It was heard in court that the victim was a flight attendant and the man indecently touched her on the flight. There is still permanent name suppression for the man.
